Who are We?
VibeMagic is the AI-assisted application development platform of Blueberry Consultants Ltd, a custom software development company formed in early 1997. Blueberry Consultants Ltd is the data controller for the personal information described in this policy.
Our head office is at 204 Scott House, The Custard Factory, Gibb Street, Birmingham, B9 4AA. The registered address is 204 Scott House, The Custard Factory, Gibb Street, Birmingham, B9 4AA.
How we Gather and use Personal Information
Customers:
As a nominated contact for a customer of Blueberry Consultants Ltd, we store and process:
- Your contact details.
- Communication sent between us.
These are processed for the purpose of project management and billing. This information will be retained for three years after your last communication with us.
This information is processed under the basis of Article 6(1)(f), legitimate interest, of the UK General Data Protection Regulation. Those regulations give you the right to request access to the information we hold about you, to request rectification of it, to erase it, to object to its processing, and to lodge a complaint with the UK Information Commissioner’s Office.
We use data storage services provided by Amazon and email services provided by Microsoft. Your data will not be used for automated decision making, and we do not use it to build a profile of you.
Enquiries:
When you send us an enquiry through our contact form we receive the name, email address, telephone number and message you provide, along with the services you tick an interest in. Before your enquiry reaches us it passes through Cloudflare Turnstile, an anti-abuse check that confirms the form was completed by a person rather than a bot. Your enquiry is then recorded in Blueberry’s internal enquiry system so that the right person can pick it up and reply.
We process enquiries under Article 6(1)(f), legitimate interest: you have asked us to get in touch about our services, and we need your details to do that.
Newsletter:
If you tick the newsletter box when you contact us, we pass your email address to Campaign Monitor, the service we use to send occasional updates about VibeMagic workshops and product news. This happens only when you tick the box, and we rely on your consent under Article 6(1)(a). Every email we send includes an unsubscribe link, and unsubscribing takes effect immediately. Leaving the box unticked has no effect on your enquiry.
Website Visitors:
We use Google Analytics and PostHog to understand how the website is used and where people get stuck. This includes page views, interactions with page controls, uncaught browser errors and, in PostHog, a playback of the rendered page and interactions during a visit. All form input values are masked before a recording is sent, URL query strings and fragments are removed, and network request bodies and headers are not recorded.
PostHog begins with cookieless page-view and web-performance measurement, both while you are deciding and if you reject Analytics. It calculates an irreversible identifier on its servers using a salt that changes daily, then strips the IP address before storing the event and deletes the salt after that day’s events have been processed. The resulting identifier cannot be reversed to recover the IP address or used to recognise the same visitor on another day. Session recording, interaction autocapture, error tracking and product events remain off unless you allow Analytics; if you do, those richer measurement features start with the safeguards described above. Google Tag Manager loads with Google Consent Mode set to denied, so Google may receive limited cookieless consent and measurement signals, but analytics storage, advertising storage, advertising user data and personalised advertising remain denied until you grant the matching permission. PostHog is configured not to create person profiles or connect analytics to your VibeMagic account identity. You can change your mind at any time using the “Cookie preferences” link in the footer of every page.
VibeMagic will not collect any personally identifiable information about you, such as your name, address or email address, without you expressly agreeing to provide it to us. We ask permission before collecting information when you sign up for a newsletter or an online demonstration, so that we can send you the information you have requested or other news items that you may be interested in.
Where account sign-in or online ordering is available to you, we also process the details needed to run that: your sign-in identity, the items in your basket, and a record of what you have ordered. Those features are described here so this policy stays accurate as they roll out.
Who Has Access to Your Information?
VibeMagic will not give or sell your personal information to any outside organisation for that organisation’s own use without your consent. We may on occasion team up with other businesses to enable us to provide special services to you, during which we will use this information, but you will be expressly asked to opt in to that new processing beforehand. VibeMagic may disclose personal information if required to do so by law or in the good faith belief that such action is necessary to conform with the law, or to protect and defend the rights or property of Blueberry Consultants Ltd, the site, or the users of our sites.
We use a small number of service providers who process personal information on our behalf, under contract and only on our instructions:
- Cloudflare, which hosts and serves this website, runs the anti-abuse check on our contact form, and provides the first-party route used to load Google Tag Manager.
- Amazon for data storage and Microsoft for email, which is where enquiries and correspondence are held once they reach us.
- Campaign Monitor, which sends our newsletter, and only if you have asked to receive it.
- Google Analytics, PostHog and Google Tag Manager, which measure how the site is used. Before permission, or after rejection, they are limited as described in the Website Visitors section above; richer analytics and advertising measurement require the relevant permission.
Some of these providers are based outside the United Kingdom. Where personal information is transferred abroad, we rely on the safeguards approved under UK data protection law, such as adequacy regulations or standard contractual clauses with the UK International Data Transfer Addendum.
How Long Your Information Is Kept
We will retain your personal information until you have not communicated with us for three years. Newsletter subscriptions are kept until you unsubscribe. We securely delete personal information as soon as it is requested by the person it belongs to, unless we are required by law to keep it, for example in accounting records.
Updating or Changing Information we Collect
The accuracy of your information is important to us. To review or edit the information in our database, please get in touch through our contact page and we will put it right.
Security
This site has security measures in place to protect against the loss, misuse and alteration of the information under our control. Traffic to and from the site is encrypted in transit, and personal information collected by us is stored in secure operating environments that are not available to the public.
Your Rights
You are entitled to view, amend or delete the personal information that we hold about you. You have the following rights:
- the right to ask what personal data we hold about you at any time;
- the right to ask us to update and correct any out of date or incorrect personal data that we hold about you;
- the right to opt out of any marketing communications that we may send you, or to have the personal data deleted entirely;
- the right to object to the processing of your information;
- the right to ask us to restrict how we use your information while a question about it is resolved;
- the right to receive a copy of information you gave us in a portable format, where we process it on the basis of your consent;
- the right to withdraw consent at any time, where we rely on consent, without affecting anything done before you withdrew it; and
- the right to lodge a complaint with the UK Information Commissioner’s Office.
We will respond to any request within one month. If you are not satisfied with how we have handled your information, you can contact the Information Commissioner’s Office at ico.org.uk, though we would appreciate the chance to put things right first.
To ask about anything in this policy, to request a copy of the information we hold about you, or to ask us to delete it, get in touch through our contact page.
